COVID-19 Liability Waiver

I personally, and/or on behalf of any minor passenger, acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing. I further acknowledge that BreakShuttle, LLC and all contracted transportation providers have put in place preventative measures to reduce the spread of the Coronavirus/COVID-19 based on CDC recommendations and industry guidelines.

I further acknowledge that BreakShuttle, LLC cannot guarantee that the passenger using this ticket will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of the passenger and others, including, but not limited to, BreakShuttle, LLC employees, contracted transportation providers, other passengers and/or their families.

I voluntarily seek services provided by BreakShuttle, LLC and acknowledge that the passenger using this ticket is increasing their risk to exposure to the Coronavirus/COVID-19. I accept the risk of the passenger being exposed to, contracting, and/or spreading COVID-19 in order to utilize BreakShuttle’s services  I acknowledge that the passenger must comply with all set procedures to reduce the spread while traveling with BreakShuttle, LLC. This includes the following conditions on the day of travel:

1. The passenger is not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell, nor has the passenger taken medication within the last 24 hours to remain fever-free.
2. The passenger does not believe they have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19 within the last 48 hours.
3. The passenger has not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non-contagious by state or local public health authorities.
4. The passenger is following all CDC recommended guidelines as much as possible and limiting their exposure to the Coronavirus/COVID-19.

I hereby release and agree to hold BreakShuttle, LLC harmless from, and waive on behalf of myself, my minor children and heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss related to exposure to and/or infection with and/or spread of Coronavirus/COVID-19 that may result from the passenger utilizing the services of BreakShuttle, LLC. . I understand that this waiver means I give up my right to bring any claims or suits including for personal injuries, death, disease, medical treatment or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen. I understand that this release is binding on me, my minor children and heirs, and/or any personal representatives. This liability waiver and release extends to BreakShuttle, LLC, together with all owners, partners, agents and employees.

I understand and agree that this agreement will be governed and construed in accordance with the laws of the State of Delaware. I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS RELEASE, AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE.
